The right of workers to organise collectively, to bargain collectively with their employers, and to withdraw their labour through strike action is constitutionally protected.
No law shall make strike action so procedurally burdensome as to render it effectively impossible. No worker shall be dismissed, penalised, or disadvantaged for participating in lawful collective action.
The right to collective bargaining means the right to genuine negotiation — not the performance of consultation while decisions are made elsewhere.
Employers operating in Ireland have a constitutional duty to bargain in good faith with the representatives of their workers.
