The judiciary is independent of the legislative and executive branches of government. Judges shall be appointed through a transparent process, involving the Citizens’ Assembly established in Article 100, designed to ensure independence, competence, and freedom from political influence. Judges are held to the higher standard of conduct established in Article 89. No judge may be removed from office except through a process that itself guarantees judicial independence, on grounds of serious misconduct or incapacity established before an independent tribunal.
